JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Bisfi P.S. Case No. 150 of 2016 registered under Sections 341, 323, 354, 504 and 506 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner along with Ram Pratap Thakur has been named in the FIR instituted on account of land dispute. He submitted that the wife of Ram Pratap Thakur had lodged the case against the members of the prosecution party vide Bisfi P.S.

Patna High Court Cr.Misc. No.59387 of 2017 (2) dt.13-12-2017 Case No. 157 of 2016. In the present case, there is a vague allegation that both the accused persons tried to outrage the modesty of the informant. It is also contended that co-accused Ram Pratap Thakur has already been extended the privilege of pre-arrest bail vide order dated 06.09.2017 passed in Cr. Misc. No.40554 of 2017.

Considering the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Benipatti, Madhubani in connection with Bisfi P.S. Case No. 150 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C.
