2. Petitioner is in custody in a case registered for the offence punishable under Section 329(3), 115(1), 117(2), 118(1), 109, 303(2), 3(5)of the BNS.

3. As per the allegation in the FIR, petitioner along with other co-accused person armed with deadly weapons and iron rod, have assaulted the informant and his family members due to which they sustained various injuries.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that there is case and counter case between the parties. He next submits that there is no allegation

No.63798 of 2025(3) dt.26-11-2025 2/2 against the petitioner that he has assaulted the informant and his family members although the allegation of assault in against other co-accused persons. He next submits that petitioner is in custody since 24.06.2025 and has got no criminal antecedent as stated in para-3 of the bail petition.

5. Learned APP for the State opposes the prayer for Regular bail of the petitioner.

6. Considering the facts and circumstances of the case as well as the submissions made by learned counsel for the petitioner, let the above named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Saharsa in connection with Sonbarsa Raj P.S. Case No.29 of 2025.
