Petitioner is accused in Durgawati Police Station Case No 61 of 2017 registered for the offence punishable under Section 394 of Indian Penal Code and Section 27 of Arms Act. Allegation is against unknown persons regarding causing firearm injuries and snatching motorcycle and some money. Counsel for the petitioner submits that upon his arrest in Mohania Police Station Case No 92 of 2017, on the basis of his extra judicial confession, he has been implicated in this case even though there is no recovery of any incriminating article from his possession. He is in custody in this case since 04.07.2017. he further submits that other co-accused, namely, Ajay Kumar Mali,

Patna High Court Cr.Misc. No.60432 of 2017 (2) dt.21-12-2017 2/2 who is similarly situated, has been granted bail by this Court vide Cr Misc No 48266 of 2017.

Considering the aforesaid submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Durgawati Police Station Case No 61 of 2017, GR No 786 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
