2. The present petition has been filed on behalf of the petitioners, apprehending their arrest, in connection with Katra P.S. Case No.20 of 2025/ G.R. No.513 of 2025 dated06.02.2025 arising out of Complaint Case No.5433 of 2024, registered for the offences punishable under Sections 63, 352, 351(2), 351(3) of the B.N.S., 2023.
3. As per allegation, both the Petitioners entered the house of the Informant and committed rape upon her daughter. The alleged victim has also given her statement under Section
Patna High Court CR. MISC. No.63804 of 2025(3) dt.10-12-2025 2/2 183 B.N.S.S., in which she has supported the allegation that both the Petitioners entered her house at night and forcibly committed rape upon her.
4. Learned counsel for the petitioners submits that the Petitioners are innocent and have falsely been implicated in this case. He further submits that there is delay of two months and nine days in lodging the complaint. He also submits that the alleged victim has refused for medical test.
5. It is also stated in paragraph no. 2 of the bail petition that the petitioners have not moved this Court earlier either for anticipatory bail or regular one in the instant case.
6. It has further been stated in paragraph no.3 of the petition that the petitioners have no criminal antecedents.
7. However, learned APP for the State vehemently opposes the prayer of the Petitioners for bail.
8. Considering the statement of the victim as recorded under Section 183 B.N.S.S., I am not persuaded to enlarge the Petitioners on bail.
9. The present petition stands rejected.
