The petitioner seeks pre-arrest bail in connection with Gaurichak P.S. Case No. 110 of 2017 registered under Sections 25(1-b)a, 26, 29, 30 and 35 of the Arms Act.
It is submitted by the learned counsel for the petitioner that the petitioner is in Army and was earlier posted in Leh and from there he was transferred to Bhatinda so he left his licence and rifle at village Hunder and the house of the petitioner was searched in his absence while he was on duty in Bhatinda. He submitted that as soon as the petitioner got information about this case from his wife, he took leave and reached to his village. Learned counsel for the State submitted that from the
Patna High Court Cr.Misc. No.58407 of 2017 (2) dt.12-12-2017 2/2 order impugned passed by the court below, it would be manifest that the licence was not renewed after 20.04.2017. Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Anant Kumar, learned Judicial Magistrate, 1st Class, Patna City in connection with Gaurichak P.S. Case No.110 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
