Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in a case registered u/s 395 of the Indian Penal Code.

As per the prosecution case, three unknown miscreants armed with pistols entered the jewellery shop of the informant and committed dacoity of jewellery and mobile sets on the point of pistol. Thereafter, they fled away by car and motorcycle.

No T.I. parade has been conducted by the prosecution. Charge sheet has already been submitted against the petitioner. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the coaccused Saurabh Kumar. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated coaccused has already been granted bail by the co-ordinate bench vide order dated 30.09.2021 passed in Cr. Misc. No. 27122 of 2021. The petitioner is also accused in six other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 29.01.2022.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner is also accused in six other criminal cases. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Teghra P.S. Case No.

Patna High Court CR. MISC. No.64456 of 2022(2) dt.22-03-2023 3/3 286 of 2020, with the condition:-

1. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. The application stands allowed.
