2. The accused/petitioner is named in the F.I.R. and apprehended his arrest in connection with Bettiah Cyber P.S. Case No. 08 of 2025 registered for the offences punishable under Section 303(2), 317(2), 317(5), 318(4), 319(2) and 61(2) of the BNS and Sections 66(C), 66(D), 84(B) and 84(C) of the IT Act.

Upon secret information informant who is a police officer raided the premises of co-accused Happy Kumar from where 15 passbooks, one cheque book and 98 SIM cards were recovered creating suspicion that petitioner along with named coaccused persons were involved in cyber fraud and to cheat innocent people.

Learned counsel appearing on behalf of the petitioner submitted that name of this petitioner transpired on the basis of disclosure as made by apprehended co-accused namely Happy Kumar, in furtherance of which nothing incriminating recovered/surfaced, which may suggest that this petitioner was involved with the present crime in question. It is submitted that seized material also not appears to connect this petitioner with the present case or project any prima-facie involvement of this petitioner with the present crime in question. While concluding the argument learned counsel submitted that petitioner found involved in one more case, where he is on bail.

5. Learned APP appearing on behalf of the State, opposes the prayer for anticipatory bail.

In view of aforesaid facts and circumstances and by taking note of the fact as save and except suspicion arising out of disclosure as made by apprehended co-accused namely Happy Kumar, prima-facie nothing incriminating surfaced against petitioner, accordingly the petitioner above named, in the event of his arrest or surrender before the learned trial court within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned
