JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The informant is not an eye witness but in course of investigation, co-accused Khushboo Devi and Lallu Rai were arrested and they confessed their guilt, disclosing the manner in which, the deceased was killed and thereafter, on the basis of confessional statement of co-accused, Lallu Rai, the dead body of the deceased was recovered. Moreover, co-accused Khushboo Devi and Lallu Rai and two others have already been granted privilege of bail by a coordinate bench of this court vide order dated 29-012016 passed in Cr. Misc. No. 58215 of 2015. So far as petitioners are concerned; except confessional statement of co-accused, there

Patna High Court Cr.Misc. No.1208 of 2016 (3) dt.18-02-2016 2/2 appears to be nothing against them.

Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Mushahari P.S. Case No. 86 of 2015 to the satisfaction of Learned Sub Judge-cum-Additional Chief Judicial Magistrate, Muzaffarpur.
