JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Learned counsel for the petitioners is permitted to make necessary correction in para 1 of the petition. Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Pakridyal P.S.Case No. 112 of 2015 instituted under Sections 272, 273 of the Indian Penal Code and 47(A), 48, 53,55 of Excise Act.
The allegation against the petitioners is that huge quantity of illegal liquor has been recovered from the possession of the petitioners.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners are the
Patna High Court Cr.Misc. No.58564 of 2015 (2) dt.09-03-2016 Mangers of the wine shop. The goods were transported from one shop to another. The said wine shop was run on the basis of valid licence . It is further submitted that the petitioners are ready to deposit an amount of Rs. 50,000/- (fifty thousand) jointly in the court below, which shall be subject to final disposal of the case. On behalf of the State, it is submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, the petitioners are directed to deposit an amount of Rs. 50,000/- (fifty thousand) jointly in the court below, which shall be subject to final disposal of the case.
Let the above named petitioners, in the event of their arrest or surrender in the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Motihari, East Champaran in connection with Pakridyal P.S.Case No. 112 of 2015,subject to the conditions as laid down u/s 438(2) Cr.P.C.
