1. Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and Section 7 of the E.C. Act.

3. As per the prosecution case, on a raid food grains were found in the godown of the petitioner which was kept for the purpose of black marketing.

4. Learned counsel for the petitioner submits that petitioner has given the room in question to his brother Sudeen Sah under a rent agreement dated 14.06.2022, where the alleged recovery has been made. Petitioner has got no concern with the alleged recovery. He is not a P.D.S. dealer. Petitioner claims clean antecedent.

5. Learned APP for the State vehemently opposed the prayer of bail.

6. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Banka/concerned court below in connection with Amarpur (Fullidumar) P. S. Case No. 555 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
