2. The petitioners pray for grant of regular bail in a case registered for the offence punishable under sections 147, 148 , 149, 341 , 448 , 323 , 307, 337, 504, 506 and 34 of the Indian Penal Code and 27 of Arms Act.

3 . The case of prosecution , in brief, is that on the alleged date and time of occurrence , when informant went to

No.69933 of 2024(3) dt.25-10-2024 2/3 the registry office at Gogri for transfer of name of his deceased Grand father in the property from his father to his brother and himself. In the meantime , all the accused persons including these petitioners came there and abused and assaulted informant and others. It is further alleged that after the incident happened in Gogri registry Office , when informant and his brother came to their house , all the accused persons armed with lathi , iron rod and other weapons entered the house of informant and assaulted informant and others due to which informant sides sustained injuries.

It is submitted on behalf of the petitioners that petitioners are relatives of informant and there admitted land dispute between them due to which these petitioners have falsely been implicated in this case . Specific accusation of assault is against co-accused Bhusan Mistri and so far as these petitioners are concerned, there is general and omnibus allegation of assault against them. Case and counter case . Petitioners claim clean antecedent. Petitioners are in custody since 15.06.2024 .

4. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed.

Let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM 1st cum ACJ M Khagaria in connection with Beldaur P.S. Case No. 209 of 2024 .
