Annexure-9 is the order, dated 09.03.2011, which is an order passed by the Special Director, Secondary Education, Government of Bihar, Patna. The petitioner was an appellant before the said authority. After the initial arguments at the stage of admission, matter was adjourned, giving direction upon the appellants and the respondents to place their evidence
Patna High Court CWJC No.14821 of 2013 dt.21-08-2015 2/2 and facts. Thereafter, the appeal was adjourned 17 times and there was none to pursue the appeal. Finally, vide order, dated 09.03.2011, the appeal has been dismissed. The said order is under challenge in the present writ.
Maintaining litigation could be a luxury for a litigant, but system has enough of load to carry. If the litigant is not vigilant enough to pursue his remedy and assert his right, naturally such applications are required to be given some kind of finality. There is nothing illegal or arbitrary with regard to the order in question. Therefore, no interference is warranted with Annexure-9. Writ application is dismissed.
