JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 326, 307, 379, 504, 34 of the Indian Penal Code. It is alleged that accused persons including the petitioners surrounded the informant when on the order of co-accused Sikandar Yadav, petitioner No. 1 Bhupendra Yadav pressed the neck of the informant, whereas petitioner No. 3 Sonu Kumar gave knife blow on the neck of the informant and petitioner No. 2 Abhimanu Kumar assaulted with the butt of the pistol and petitioner No. 4 snatched cash and gold chain of the informant.
It is submitted by learned counsel for the petitioners that except one injury other injuries have been found to be simple and there is counter version of the
Patna High Court Cr.Misc. No.290 of 2016 (2) dt.06-01-2016 2/2 occurrence also.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Salkhua P.S. Case No. 154 of 2015, pending in the Court of learned Chief Judicial Magistrate, Saharsa.
With the observations above, the application stands disposed off.
