The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 of the Indian Penal Code.

The prosecution case is that the accused persons came variously armed, assaulted the informant, his brother and his nephew. It is alleged against the petitioner that he assaulted along with Santosh Prasad and Diwakar Prasad to Birendra Kumar. When Ashok Prasad took out Rs. 1,000/- from the pocket of Birendra Prasad and this petitioner threw chilii power on the informant, his elder brother and his nephew.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.2671 of 2016 (3) dt.02-02-2016 petitioner that injury of Birendra Prasad has been found only swelling and pain on the hand when it is alleged that he was assaulted by three persons including the petitioner. There is no injury caused with chilli powder either to the informant, his brother or his nephew. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Imamganj P.S. Case No. 140 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
