1. Heard learned counsel for the petitioner and the learned APP for the State.
2. The petitioner apprehends his arrest in connection with Gurua P.S. Case No. 346/ 2022 dated 14.09.2022 registered for the offence(s) punishable under Section(s) 448 and 354 of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioner are that there is no serious allegation against this petitioner and as per FIR, he simply entered into the house of the informant and misbehaved with her and tried to pull the victim's scarf and except this, there is no other allegation regarding any attempt to outrage the modesty of the informant and the petitioner is co-villager and neighbour of the informant having fair and clean antecedent and the FIR with
Patna High Court CR. MISC. No.69680 of 2023(2) dt.08-11-2023 2/2 false allegation has been lodged against him on account of village politics.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Though, against the petitioner there is serious allegation of entering into the house of informant and attempting to outrage her modesty but considering petitioner's fair and clean antecedent and his young age, in my opinion, petitioner deserves to the privilege of anticipatory bail. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Gurua P.S. Case No. 346/ 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
