JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2016 The petitioner has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 409, 419, 420, 467, 468, 471 and 201 of the Indian Penal Code. The petitioner preferred earlier Cr. Misc. No. 20904 of 2014 with a prayer for anticipatory bail but the same got dismissed for non-compliance of the peremptory order dated 05.09.2014 and 23.09.2014 passed by a co-ordinate Bench of this Court (now retired).

The prosecution case is that in an appeal, under RTI, educational and training certificates of the petitioner were demanded by one Ejajul Sheikh from the office of District Education Officer, East Champaran, Bettiah, thereafter, the Headmaster of the school, where the petitioner was teacher, was directed to make available the relevant documents, subsequently, a

Patna High Court Cr.Misc. No.1555 of 2016 (2) dt.13-01-2016 2/2 departmental proceeding was initiated against the petitioner. The petitioner failed to produce required documents claiming that the entire educational certificate got burn in the year 2010. It is submitted by learned counsel for the petitioner that final order has not been passed in departmental proceeding and though, the petitioner was appointed in the year 1976 but has now retired.

Considering the nature of accusation and the fact that the case was registered in the year 2013, this Court is not inclined to interfere.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Sikta P.S. Case No. 109 of 2013 pending in the court of learned CJM, West Champaran, Bettiah. Accordingly, the application is disposed of.
