JUSTICE ARUN KUMAR ORAL ORDER 24-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Chhatapur PS Case No. 331 of 2017 registered under Sections 307, 341, 323, 324/34 of the IPC and Section 27 of the Arms Act. The allegation in brief is that the informant's younger brother shot at the informant due to property dispute aiming at the chest but it hit the arm causing fire arm injury. Learned Counsel for the petitioner submits that due to property dispute the petitioner has falsely been implicated, there is only lacerated injury on the arm of the informant. Moreover both are full brother and the informant has filed compromise petition in the court below. The petitioner is in jail since 24.9.2017. Having considered the specific allegation against the petitioner and the injury sustained by the informant the prayer for bail of the petitioner is refused.

The trial court is directed to expedite the trial and preferably conclude the same within a year.
