This petition has been filed before a wrong forum. The impugned order dated 9.5.2012 appears to have been passed during the pendency of Sessions Trial No. 142 of 2012 by the learned 1st Additional Sessions Judge, Sitamarhi and the Court is of the opinion that a petition which was required to be filed was that in the form of a revision petition preferred under Sections 397 and 399 Cr.P.C.

Let the petition be converted into a Cr. Revision petition and be listed before the appropriate Bench within one week.
