JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and some four others were arrested by the police while they had assembled to making preparation for committing dacoity and one country made loaded cutta was recovered from conscious possession of the petitioner. Learned counsel for the petitioner submits that prior to institution of present case, petitioner was made accused in Saharsa P.S. Case No.654 of 2013 but when he was arrested in the present case, petitioner was remanded in four other cases which had been lodged against unknown persons.

Considering the aforesaid submissions as well as this aspect of the matter that petitioner is in jail custody for more than

No.96 of 2016 (2) dt.05-01-2016 2/2 seven months, let the petitioner above named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Sahara in connection with Saharsa P.S.
