The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 341, 307, 372, 504 and 323 of the Indian Penal Code. The prosecution case is that the co-accused Balindra Singh, and Surajbhan Singh tried to throttle the informant by putting rope around his neck, thereupon the petitioner Nagendra Singh and co-accused Mithilesh Singh and Sonu Singh assaulted and took out Rs. 15,00/-and mobile of the informant. It is submitted by the learned counsel for the petitioner that accusation of assault is omnibus and general and injuries have been found superficial simple in nature. The
Patna High Court Cr.Misc. No.4697 of 2016 (2) dt.04-02-2016 2/2 accusation of throttling is not against the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/ (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Siwan, in connection with Ziradei P.S. Case No. 07 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
