JUSTICE SAMARENDRA PRATAP SINGH ORAL JUDGMENT Date: 02-05-2016 Heard learned counsel for the petitioner and the respondents.

The petitioner retired on 31.07.2013, as a Basic Health Worker, while working in the office of Primary Health Centre, Madhepura in the district of Madhepura.

The grievance of the petitioner is that though he has retired three years back, he has not been paid any pensionary benefits. The petitioner in this respect has filed representations before the respondent nos. 4 and 6.

In case, the petitioner files a fresh representation

Patna High Court CWJC No.2956 of 2016 dt.02-05-2016 2/2 before respondent no.6, he would forthwith processes the application for retrial benefits to the controlling officer for due sanction and payment of the admitted dues. It is further observed that admitted dues should be paid to the petitioner within a period of four months from the date of receipt of a copy of this order. The petitioner submits that even provisional pension has not been paid.

Having regard to the facts of the case, if the petitioner files a fresh representation before the Civil Surgeon, Madhepura, for grant of provisional pension, he would process the same, so that the petitioner is paid his admitted dues within a period of four months from the date of receipt of representation along with a copy of this order.

The writ application stands disposed of.
