The petitioners have filed the instant application for grant of regular bail in connection with Ramgarh P.S. Case No. 50 of 2022 registered under Sections 302, 304(B), 498(A), 109/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act. It is a case of dowry death of the informant's daughter due to non-fulfillment of dowry demand of motorcycle. Learned counsel for the petitioners submits that petitioner are innocent and have committed no offence. They have falsely been implicated in this present case due to ulterior motive. It is further submitted that petitioner no.1 is Gotini whereas petitioner no. 2 is brother-in- law of the deceased. They have no concern mess and business of the deceased and her

Patna High Court CR. MISC. No.63712 of 2022(2) dt.18-01-2023 2/2 husband. Petitioners were living separately from the deceased and her husband. There is nothing specific allegation against them. A statement has been made in para 3 of this petition that petitioners have got no criminal antecedent. Similarly situated co-accused has already been granted bail by this co-ordinate Bench of this Court vide order dated. 26.08.2022 in Cr. Misc. No. 27225 which is annexed as Annexure-3. Petitioners are languishing in judicial custody since 12.09.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Ramgarh P.S. Case No. 50 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st Kaimur at Bhabua.
