The petitioner seeks bail in Vaishali (Belsar) P.S. Case No. 104 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.

Informant has alleged in the FIR that on 23.04.2017 while he was returning from his shop, he was over-powered by the two unidentified miscreants on the point of revolver who looted Rs. 40,000/-, ornaments of gold and silver amounting to Rs. 50,000/- and also snatched the key of the shop, when people gathered there the unidentified miscreants fled away. The name of the petitioner has surfaced in the case on the basis of confessional statement of Bhim Sahani. Except the said

Patna High Court Cr.Misc. No.59570 of 2017(3) dt.15-01-2018 2/2 confessional statement, there is nothing incriminating against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since, 17.06.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (Belsar O.P. ) P.S. Case No.104 of 2017. (S. Kumar, J) ranjan/- U
