Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 498A, 504 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.
Allegation against the petitioner is that he assaulted his wife Rani Devi (deceased) and caused injury and during treatment the doctor declared him dead.
Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. He further submits that the victim was died during course of treatment. He further submits that during course of investigation not a single witness alleged against the petitioner.
Patna High Court CR. MISC. No.63961 of 2022(3) dt.27-03-2023 2/2 Learned APP for the State, on the other hand, on the basis of material available on record as well as case diary, vehemently opposed the prayer for bail of the petitioner, submits that it has come in the postmortem report that the cause of death to force around the neck as a result of strangulation and the victim was also pregnant about eight weeks.
Considering the postmortem report, I am not inclined to enlarge the petitioner on bail in connection with Mehsi (Jaibajrang O.P.) P.S. Case No. 168 of 2022 pending in the Court of learned Additional Chief Judicial Magistrate-VI, Motihari, East Champaran.
Prayer is refused.
