1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Complaint Case No. 1673 of 2022 registered under Section 376 and other allied sections of the Indian Penal Code.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to enmity. Further he submits that the complaint case is lodged with allegation of rape after two days of the alleged occurrence. There is no medical evidence. It is further submitted that in the instant case, a case
Patna High Court CR. MISC. No.67794 of 2023(2) dt.19-10-2023 2/2 was also filed on behalf of the petitioner's side against the husband of the complainant and others.
4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Samastipur in connection with Complaint Case No. 1673 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
