2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 20, 22 and 29 of the NDPS Act.

3. The case of the prosecution is that on the basis of secret information that three persons were carrying contraband articles, a police party proceeded near Hanuman Mandir. On noticing the police, the said individuals attempted to flee. Whereupon two of them were apprehended while one one managed to escape.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case.

No.67368 of 2025(2) dt.17-09-2025 2/2 It is further submitted that apprehended persons during investigation, have merely named this petitioner and except for such allegation nothing incriminating has been recovered from his conscious possession. It is also submitted that neither the petitioner has neither been put on Test Identification Parade (TIP) nor has he any criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 29.07.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kotwali P.S. Case No. 350 of 2010 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge (NDPS), Patna.
