====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 Petitioner seeks regular bail in connection with Koilwar P. S. Case No. 307 of 2018, registered for the offences punishable under Sections 302 and 120 B of IPC and Section 27 of the Arms Act.

As per the prosecution case, petitioner and three other accused persons fired on the deceased, causing injuries, due to that he died.

Submission of the learned counsel for the petitioner is that though four persons are said to have fired on the deceased, which will appear from the postmortem report and moreover, the other accused persons having similar allegation have been granted bail by a Co-ordinate Bench of this Court, vide order dated 26.04.2019 passed in Criminal Misc. No. 8114 of 2019 and vide order dated 25.09.2019 passed in Criminal Misc. No. 43996 of 2019. Further submission is that petitioner is in

Patna High Court CR. MISC. No.60310 of 2019(4) dt.08-01-2020 2/2 custody for more than one year and now the charge has also been framed.

Having heard both sides, considering the submissions, as made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Koilwar P. S. Case No. 307 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to co-operate in disposal of the trial, otherwise, his bail bonds shall be concelled.
