2. After some arguments, the learned senior counsel appearing for the petitioners prays for withdrawal of the present application to approach the learned court below for regular bail upon surrender.

3. At this stage, it has also been pointed out by the learned counsel appearing for the petitioner that the main accused of the case Ashok Kumar Yadav and Siya Sharan Yadav, who have been named in the first information report have

Patna High Court CR. MISC. No.75293 of 2024(3) dt.16-04-2025 2/2 already been enlarged on regular bail by the Hon'ble Apex Court in SLP No. 15934 of 2024, which is evident from the order dated 07.02.2025 passed in Cr. Appeal No. 15934 of 2024.

The present application on behalf of the petitioner is permitted to be withdrawn with the liberty to approach the learned court below for grant of regular bail, which shall be considered on its own merits without being prejudiced by the present withdrawal order and the learned court below would also consider that the main accused of the case Ashok Kumar Yadav and another have already been granted privilege of regular bail.
