The petitioner is in custody since 25.10.2017 in connection with a case registered for the offences punishable under Sections 7 of the E.C. Act.

Learned counsel for the petitioner submits that the petitioner is the tractor owner on which certain bags of rice were found to have been carried for illegal sale. The petitioner is neither the P.D.S. owner nor he has any licence, but only because certain food-grains were carried in the tractor, he has been named in the First Information Report and he has been prosecuted. He is a man of clean antecedent.

Considering the aforementioned facts and circumstances and that no case under the E.C. Act is made out

Patna High Court Cr.Misc. No.59096 of 2017 (2) dt.14-12-2017 2/2 against the present petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Shergahti, Gaya, in connection with Dumariya P.S. Case No. 83/2016.
