On account of taking away a packet of Kurkure by the son of the petitioner, namely, Shaurabh Kumar from the shop of informant Munaka Devi, she complained the petitioner whereupon, petitioner has said that he will pay the price later on which was not acceded by the informant, followed with an altercation during course of which she was assaulted by fist and slap. Furthermore, she was chased to her house where it has been alleged that Dilip Ram (petitioner), Shaurabh Kumar, Jaiki Kumar, Rohit Kumar, Raushan Kumar, Monu Kumar, Abhishek Kumar, Tinku Kumar, Anoj Kumar, Sanoj Kumar brick-batted as a result of which her son Jitendra Kumar, wife of Jitendra Kumar as well as her grand daughter Shiwani Kumari aged about two and half months sustained injury. Later on, Shiwani Kumari died.
Patna High Court Cr.Misc. No.59270 of 2017 (2) dt.12-12-2017 Considering the nature of the allegation, petitioner Dilip Ram is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned ACJM, Danapur, Patna in connection with Bihta P.S.
