2. The petitioner seeks bail in connection with Chautham P.S. Case No. 113 of 2025 registered for the offence punishable under Sections 137(2) of the Bharatiya Nyaya Sanhita and which was later on converted into Sections 103(1), 238, 61(2) and 3(5) of the B.N.S.

3. The petitioner is a woman and is accused of being an accomplice in the killing of the child by one Khushbu Devi.

4. The petitioner is in custody since 13.05.2025.

5. Learned counsel for the petitioner submits that the petitioner was carrying a pregnancy of six months at the time of occurrence and she cannot participate in the occurrence and she has been falsely implicated in this case.

6. Considering the custody, the fact that the petitioner is a woman and the fact that Khushbu Devi is the main accused, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria/ concerned Court in connection with Chautham P.S.
