JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 28-03-2016 Heard the counsel for the petitioner and the State. The petitioner claims himself as a senior citizen and full brother of respondent no.8. Mother of the writ petitioner and respondent no.8 was in service and died in harness sometimes in March, 1982. In the year 1989 respondent no.8 was provided with appointment on compassionate grounds as Peon in a High School.
The petitioner raises a grievance that the respondent no.8 has now evaded to maintain or support him. Without stating
Patna High Court CWJC No.14517 of 2013 (2) dt.28-03-2016 2/2 the terms of the appointment or the affidavit filed for securing the compassionate appointment, it has been submitted that it is the legal obligation of respondent no. 8 to support the petitioner. This Court is unable to appreciate these contentions in the absence of the relevant pleadings supported by documents. Even otherwise, such grievance, if any, ought to have been raised before the appropriate authority/forum in accordance with law. The writ application stands disposed of with the said liberty.
