JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-01-2024 The present petition has been filed for restoration of a petition bearing CWJC No. 8834 of 2023, which has stood dismissed on account of non-compliance of the peremptory order dated 03.07.2023.

The learned counsel for the petitioner has submitted that on account of inadvertence the peremptory order of this Court dated 03.07.2023 could not be complied with, however, the same

Patna High Court MJC No.2729 of 2023(2) dt.25-01-2024 2/2 shall be complied with within a period of four weeks from today, hence a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing CWJC No. 8834 of 2023 to its original file, subject to removal of the defects pointed out by Registry, within a period of four weeks from today.

The present petition stands disposed of on the aforesaid terms.
