The petitioner seeks pre-arrest bail in connection with Rajoun P.S. Case No. 117 of 2019 for the offence alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving secret information about selling of the illicit liquor by eight persons, including the petitioner, the informant, along with other police personnel, reached there. Seeing the police party all succeeded to flee away. On search, 16 liters of country made liquor recovered from there in a plastic pouch. Local Chowkidar identified them, including the petitioner, at the time of fleeing away from the place of occurrence.

The submission of the learned counsel for the petitioner is that in fact the petitioner is accused in four cases in

Patna High Court CR. MISC. No.59982 of 2019(2) dt.23-09-2019 2/2 which he is on bail, which is detailed in paragraph 3, due to that, the informant, who is police official, implicated the petitioner in the present case.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Rajoun P.S. Case No. 117 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, II, Banka, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
