1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. Learned counsel for the petitioner submits that petitioner has antecedent of two cases.

4. Allegation is of recovery of 30 litres of liquor from a motorcycle.

5. Learned counsel for the petitioner submits that petitioner was not arrested from the spot, as such, nothing was recovered from his conscious possession and he came to be implicated for the reason that the motorcycle was registered in the name of his wife. It is further submitted that no prudent person would use the vehicle registered in the name of his wife

Patna High Court CR. MISC. No.68937 of 2024(3) dt.26-10-2024 2/2 for committing an occurrence and thus would create evidence against his wife. It is next submitted that petitioner was completely unaware that his neighbour would misuse the vehicle in the manner as alleged.

6. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

7. Considering the submissions, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Madanpur P.S. Case No. 302 of 2024.
