2. The petitioner is in custody in a case registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per allegation in the FIR, total 50 liters of spirit has been recovered from the house of petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from the conscious possession of the petitioner and petitioner is in custody since 28.05.2025 and there is no independent witness of the seizure

5. Learned APP for the State opposes the prayer for bail of the petitioner.

In view of the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.I, East Champaran at Motihari or his successor Court in connection with Harsidhi P.S.
