JUSTICE SHIVAJI PANDEY ORAL ORDER 15-11-2016 In the present case, petitioners are claiming the appointment against Advertisement no. 1/2012, as they appeared in the written test.
Petitioner nos. 1 and 2 have claimed belonging to be backward category and petitioner no. 7 claims to be member of the Gorkha community. At the time of physical test, petitioner nos. 1, 2 and 7 could not produce the respective testimonies to prove their classes, petitioner no. 3 could not achieve the cut off marks, other candidates could not be selected though they have cut off marks
Patna High Court CWJC No.14375 of 2013 (3) dt.15-11-2016 2/2 but on the date of the date of birth and seniors have been appointed.
In such view of the matter, this Court does not find any error in the action of the respondents.
Accordingly, this petition is dismissed.
