Petitioner seeks bail in a case registered for the offences punishable under Sections 436, and 427 of the Indian Penal Code.

Allegation against the petitioner is that he committed arson in the house of the informant causing damages. Submission is that since the petitioner is cosharer of the informant, false allegation has been lodged on suspicion. It is unbelievable that in the wee hours of night the informant would see the petitioner committing the crime alleged. Petitioner is in custody since 02.04.2019. Investigation of the case is already complete. Petitioner is ready to cooperate with the trial. There is no allegation of tampering with the evidence.

No.66453 of 2019(3) dt.13-12-2019 2/2 Finding substance in the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Banka Police Station Case No.210 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
