JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Barachatti P. S. Case No. 478 of 2017, disclosing offences under Sections 30(a), 38 and 47 of the Bihar Prohibition and Excise Act, 2016.

On information police intercepted a Bolero vehicle and seized 240 liters of foreign liquor from the vehicle. Submission of the learned counsel for the petitioner is that he was not present at that time and from his vehicle recovery is there. He has no criminal antecedent. The vehicle was in possession of the driver.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned
