====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with NDPS P.S. Case No. 39 of 2019 arising out of Excise Case P.R. No. 39 of 2019 registered for the offence punishable under Sections 20(B) of N.D.P.S. Act, 1985.

As per FIR, allegation against the petitioner is that 50 kgs of ganja was recovered from the Bolero vehicle which was allegedly been driven by the petitioner.

Submission of the learned counsel for the petitioner is that the petitioner is merely the driver of the truck from which the alleged recoveries were made. He has no knowledge of ganja recovered. He is in custody since 28.04.2019. Heard learned A.P.P. for the State.

Having heard the submissions made by both the

Patna High Court CR. MISC. No.79696 of 2019(4) dt.24-02-2020 2/2 parties and in view of the above facts, I am not inclined to grant regular bail at this stage.

Accordingly, this application is dismissed.
