JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Raghunathpur P.S. Case No. 142 of 2019 registered for the offences punishable under Sections 30(a) and 41 of Bihar Prohibition and Excise Act.

As per FIR there is recovery of huge quantity of liquor from Ramanand Choudhary and Suman Gond and allegation against the petitioner is that he along with others fled away.

Submission of learned counsel for the petitioner is that there is no recovery from his possession and specific allegation is made against other accused persons and only allegation against him is that he was seen fleeing away from the place of occurrence, having no criminal antecedent. Heard learned APP also.

No.60166 of 2019(2) dt.23-09-2019 2/2 In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with Raghunathpur P.S. Case No. 142 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
