Petitioner seeks anticipatory bail in Rajgir P.S. Case No.217 of 2017 instituted for the offences under Sections 341, 323, 307, 353, 427, 504 and 506/34 of the I.P.C. Informant is the employee of Nagar Panchayat Rajgir who has alleged in his F.I.R. that on 19.09.2017 at about 3 P.M. when he was performing his duty then temporary employees came there and were agitating for payment of honorarium and they assaulted him and also they threatened to kill him. There is allegation against the petitioner of using filthy language against him.
It has been submitted by the counsel for the petitioner
Patna High Court Cr.Misc. No.60539 of 2017 (6) dt.19-02-2018 2/2 that there is no allegation of any overt act against them. The petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Nalanda at Bihar Sharif, in Rajgir P.S.Case No.217 of 2017 subject to the condition as laid down under Section 438(2) of Cr.P.C.
