The petitioner has been in custody since 17.06.2017 in connection with Chandradeep P.S. Case No. 82/2014 registered for the offences punishable under Sections 147/148/149/341/323 /324/307/504/506 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that though it is alleged that he had fired on the shoulder of the informant yet the injury report as found in the case diary indicates that the injury on his shoulder was that of hard and blunt substance. It is further submitted that the other person who had been attacked, namely, Kundan Yadav has not been examined during the investigation which also places a cloud on the
Patna High Court Cr.Misc. No.60918 of 2017 (3) dt.19-01-2018 2/2 prosecution.
In view of the aforementioned facts and circumstances and also the period of custody, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jamui, in connection with Chandradeep P.S. Case No. 82/2014.
