ANJANA MISHRA ORAL ORDER 24-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.06.2019 in connection with Mairwa P.S. Case No.154 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession and the petitioner was the pillion rider of the vehicle from which the alleged recoveries were made. The petitioner has no criminal antecedents.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal

Case No.154 of 2019.
