No. 7972 of 2014, whereby liberty was given to the petitioner to file representation before the Circle Officer, Andhratharhi within a

Patna High Court MJC No.626 of 2018(3) dt.19-09-2019 2/2 period of three weeks for removal of encroachment and Circle Officer, Mokama was supposed to dispose of the representation within a period of four weeks of the filing of the representation and if he would find that the land in question is a public land/road then he would initiate encroachment proceeding under Bihar Public Land Encroachment Act and would conclude the same within a four months, after giving due opportunity of hearing to all the affected persons in accordance with law. The show cause has been filed on behalf of opposite party nos. 3, 4, 5 and 6 stating therein that the encroachment proceeding has been initiated being Encroachment Case No. 04/2017-18 and the same has been finally disposed of vide final order dated 23.10.2017.

In the circumstances, this Court does not find any reason to proceed further in the matter. However, if the petitioner is aggrieved with the final order passed in Encroachment Case No. 04/2017-18, he is at liberty, if so advised, to challenge the same in an appropriate proceeding.
