In this case, the petitioner is seeking anticipatory bail in connection with Complaint Case No.C1-1146/18 registered for offence under section 498(A)/34 of the Indian Penal Code. The opposite party no. 2 herself is present in the court and her counsel submits that she is ready to go and live with the present petitioner.

The counsel for the petitioner submits that the petitioner is ready to keep the opposite party no. 2 with proper respect, dignity and security.

In view of the statement made at the Bar, the petitioner, in the event of arrest or surrender before the court

Patna High Court CR. MISC. No.59942 of 2019(3) dt.20-11-2019 2/2 below within six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Complaint Case No.C1-1146/18, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

The opposite party no. 2 is directed to remain present before the court below on 13th of December, 2019 and from where the petitioner would carry the opposite party no. 2 along with his daughter. In failure to complete his undertaking, the relief granted to the petitioner will be treated to have been withdrawn. (Shivaji Pandey, J) Mahesh/- U T
