Petitioner seeks bail in connection with S.T. No. 238 of 2017 arising out of Khagaria (Gangaur) P.S. Case No. 124 of 2017 registered for the offences under Sections 399, 402 of the Indian Penal Code, Section 25(1-b)a, 26, 35 of the Arms Act, Section 3⁄4 of Explosive Substances Act and Sections 16, 17, 18, 19, 20, 21, 40 of U.A.P. Act.

It is alleged that the police party on secret information conducted the raid at the house of co-accused Sanoj Yadav and apprehended three persons, Chano Sada, Udgar Sahani and Sanoj Yadav and from their possession some arms and ammunitions were recovered.

Patna High Court Cr.Misc. No.62824 of 2017 (2) dt.10-01-2018 It has been submitted by the learned counsel for the petitioner that similarly situated co-accused Sanoj Yadav and Udgar Sahani have been granted bail vide Cr. Misc. No. 38705 of 2017 and Cr. Misc. No. 55871 of 2017 on 19.08.2017 and 20.11.2017 respectively. The petitioner is in custody since 01.03.2017 and there is nothing against the petitioner except an antecedent in which he is on bail.

Considering the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Fast Track Court No. II, Khagaria in connection with S.T. No. 238 of 2017 arising out of Khagaria (Gangaur) P.S. Case No. 124 of 2017. (Sanjay Kumar, J) AnilKrSinha/- U
