2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, this petitioner along with other co-accused were fleeing with the tractor of the informant and on chase, co-accused Veeru Yadav fired causing injury on the palm of the informant and thereafter, co-accused Mantu Yadav also fired but missed.
4. It is submitted on behalf of the petitioner that there is no specific allegation of firing against this petitioner. He is simply stated to be one of the co-accused who was present at the
Patna High Court CR. MISC. No.66442 of 2023(2) dt.18-10-2023 2/2 place of occurrence. Petitioner claims clean antecedent.
5. Learned APP for the State vehemently opposed the prayer of bail.
6. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya/concerned court below in connection with Bodhgaya P. S. Case No. 546 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Shishir/- U T
