The petitioner apprehends his arrest in connection with Siwan C-III No. 188 of 2019, registered under Section 30(a) of the Bihar Excise Act, 2016.
The accusation is of recovery of 264 bottles each containing 500 ml beer, 48 bottles each containing 375 ml and 216 bottles each containing 180 ml Indian made foreign liquor and 41 bottles each containing 200 ml country made liquor from the house of Rakesh Kumar, while at that time, two persons succeeded to flee away. The local people disclosed the name of Rakesh Kumar and Rambabu Kumar (petitioner), who are indulging in selling of illicit liquor.
Patna High Court CR. MISC. No.59563 of 2019(2) dt.20-09-2019 2/2 Learned counsel for the petitioner submits that petitioner is not apprehended at the spot but his name has been disclosed by the co-villagers due to dirty village politics. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 2nd Additional Sessions Judge-cum-Special Judge Excise, Siwan, in connection with Siwan C-III Case No. 188 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
