2. The petitioner seeks bail in connection with Taraiyan P.S. Case No. 98 of 2025 registered for the offence under Sections 308(3), 316(2), 318(4), 338, 336(3) of the BNS.

3. From the reading of the FIR, it appears to be a dispute for Rasta. The petitioner submits that there is no Rasta over the plot which belongs to him and therefore he was using the disputed plot as a Rasta.

4. Learned counsel for the informant submits that plot has been purchased by him for constructing a house and this petitioner is creating trouble right from the day of purchase of plot by the informant.

5. At this juncture, the learned counsel for the petitioner has submitted that he will not claim any Rasta over

Patna High Court CR. MISC. No.63966 of 2025(2) dt.10-09-2025 2/2 the plot of the informant until and unless he gets any order of the Civil Court/ An Authroity. He also submits that the petitioner will not interfere in the peaceful possession of the informant in future.

6. Considering the nature of dispute and the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIII, Chapra/concerned Court below in connection with Taraiyan P.S. Case No. 98 of 2025.

8. At the time of furnishing the bail bonds, the petitioner will give an undertaking with respect to the submissions made on his behalf and the bail bonds of the petitioner shall only be accepted after the undertaking of the petitioner.
